The Work Week

The workweek is a fixed and regularly recurring period of seven consecutive 24-hour periods. The employer sets the workweek. It can begin on any day and at any hour of the day.

An employer may use a workweek beginning on one day for one plant or group of employees and on a different day for different plant or groups of employees. Once the beginning time of an employee's workweek is established, however, the employer cannot change it regardless of the schedule of hours worked by the employee. The employer can change the beginning of the workweek if the employer intends the change be permanent and is not changing the work week to avoid paying overtime.

The proper method of computing overtime pay in a period in which a change in the time of commencement of the workweek is made, is discussed in Secs. 778.301 and 778.302.
