is it legal for employers to not pay vacation pay after quitting

I have worked for a condo in palm beach for about 3 years, i have givin 2 weeks notice, at the end of this i asked my boss about my vaction pay, which is 40 hours now , she told me she doesnt have to pay me is this true?

Payment of Vacation Pay

The answer is "it depends." That is depends on whether your former employer had a written policy as to when vacation pay accrues. You would probably need to show a lawyer any written employment manual or describe any oral policies as to vacation pay that were relayed to you. If vacation pay is owed, you would then have a legal right to seek it as well as your attorneys fees and court costs incurred in recovering it.
