Severance Pay vs. Vacation pay

I was laid off and given severence pay. A few days later I contact payroll to inquire about my vacation pay. They told me I don't get paid for vacation time left over. I then filed a claim with the state of CA. They are in the process of getting a court date to compensate me. The company that laid me off had thier lawyer call me and tell me that the severence included my vacation pay. My question is this . . .Is vacation pay seperate from severence?

Vacation Pay

You are normally entitled to all accrued vacation time/pay at the time of layoff. It is possible that this was folded in to the severance pay. You would need to review the severance agreement you signed.
