overtime pay/ harassment

I have been working as a General Mgr for a fast food Rest. For about a year. I have many weeks that I worked more than the 55-60 hours I was told I I needed to work. I an paid a flat salary. I really would like to know if I would be exempt for overtime or not. The company hand book states that mgr are not to exceed 55 hours with out the supervisor permission. The hand book was issured after I had worked there for about 10 months. Each time I would asked for one I was told they was at the lawyers office. We did finally get them. I worked many weeks 70-80 hours a week. The second part of my question is on a supervisor calling me baby, I did not like this and made me fell unconfortable. NO I did not say any thing to him,, I was kinda scared of what he might say or do. can you place guide me on this ? THANK YOU.

Overtime/Sexual Harassment

1. If you are a manager you are exempt from the overtime provisions of the Fair Labor Standards Act. However, just because your employer calls you a manager does not mean that you are exempt. You must spend a significant amount of your time doing "management" duties. If you do not, then you may have an overtime claim. If you have more questions, please contact me 800.404.7868 or visit my website on this subject, www.flsaclassaction.com.

2. If you are uncomfortable, you must report your supervisors' behavior to your company. They should have a policy/procedure for this. If not, they could be in big trouble. Again, if you have more questions, please feel free to contact me at 800.403.7868 or acrone@cronemason.com or see my website on this subject, www.americanworkrights.com.
