my husband has been told he is too expensive for overtime

My husband trained his boss, he has worked at the same company for 20 plus years and is now 49 years old. He works in a lab with 4 other guys all of whom have less time on the job than him. He is bypassed for overtime and has been told by his supervisor that he is too expensive for overtime (he is on hourly). Is this legal? Is he entitled to the same consideration as the other employees? It seems that he is being discriminated against for working there faithfully for the length of time he has worked and the other employees are being rewarded with the overtime. Which is really needed right now.
