final wages

I work on h1b visa ..recently i moved to new company and my previous employer
stopped paying my salary for last 2 months ..I sent him couple of emails and left couple of
voice messages but no response from him ..I came to know he never paid to another
employee for 2 months .So we both wanted to pursue the matter together with
that employer ..What is the best option to get back wages ?

one more question is i get paid partly as salary and per diem and I remember once my employer saying he can hold not paying per dime .is it right ?

Texas Payday Law

The Texas Workforce Commission enforces the Texas Payday Law. It sounds like your former employer violated that law. You should therefore file a claim with the Texas Workforce Commission. It has a web site and I'm pretty sure you can file your complaint on line.
