Pregnant and Work

I am currently 9 months pregnant and expecting to have my baby any day now. I’m currently working for a company that has just filed for chapter 11. I received a letter in the mail from my HR and Payroll Company informing me that my benefits (short term and long term) have been termed because my company couldn’t pay them the correct amount of money. Well I also was informed that I would possibly be laid off for force of reduction. My company is not sure what to do with me because im not covered under FMLA and they feel that if they lay me off I could possibly come back and get them for something. Honestly I feel like my best bet right now would be to get laid off and collect unemployment. Considering that im not covered under any law and I do not have short term disability. How can I prove to my employer that they have every right by law to lay me off?
