Laid off but my employer says I resigned - can they do that?

I signed a separation agreement after being laid off (unexpectedly) in order to receive my severance package. I recently discovered that my previous employer has sent out letter(s) informing people that I had resigned and that my resignation was "unforeseen by all." Can they do that? It could possibly affect my reputation.

The severance agreement might stop this.

It depends on what you agreed to when you signed the document that got you your severance pay. It also depends on the exact contents of the letter and what a fair reading of that letter would be. You need to get yourself to an employment lawyer in your part of the state for legal advice.
