Do I have a case to go after?

I have worked for the company for almost 3 years. My boss decided to go with another company and hire them to do what I was doing. So my position disappeared.
He set and interview for me with the new company he was hiring to take my position and they offered me a job.
I didn't take the job for different reasons.

When I asked my boss about a severance package he said I was NOT entitled to one since he didn't fire me he found me a job with another company. I told him he closed my position. So he left me no choice.

My contract with him was in writing and it stipulates that I am entitled to two months of salary for the amount of time working in the company. It was signed by both when I started working for the company.
One day he called me and said he was going to pay me one month. To be fair to me.

He sent me a check I just received with an additional deduction of about 35% of one month pay. He not even pay me 2 full months according to the contract I signed, he only paid me portion of a month.

Can I sue him for this? Is this worth the fight? Do I have a case?

Also, can I deposit the check to ensure this amount and the fight the rest of the amount?
