Unpaid wages from Nov. 07

I am putting my city/state as Marietta OH because that is where I worked. I actually live in WV but assume the case would be an Ohio case.

I was employed with this company for over a year. My last day was Nov. 30th (my position was eliminated and I declined a transfer to another office) I have never received my last check. It's not much (about 25 hours worth of pay) but have not been able to get anywhere with the company. They keep telling me to "call back tomorrow, there are no new case notes."

I have been told by workers in the HR department that my case should have been escalated when it was originally developed because I'm no longer employed and because it is for more than 20 hours of pay. I have still not seen a check.

My impression of Ohio law is that these wages (from the last two weeks of November) were to be paid by Dec. 15.
The company was notified of the error (me not getting my check) Dec. 13th. The HR department has been contacted numerous times by myself.

I am wondering what the appropriate legal action to take would be. At this point, I am incredibly irritated with the company and want to do whatever is possible. (They are a very large national corporation)

Hopefully you have been paid by now. If not, then you would at least have a Federal Minimum Wage claim for the 25 hours that you worked. In addition to that, you may be entitled to liquidated damages in the same amount. Now, you may have additional remedies in Ohio in addition to the federal claim. Generally, your paycheck is due on your regular scheduled payday.
