Forced to work for free to collect owed bonus

Myself as VP, another VP and the CEO negotiated a bonus plan that pays a % of profit quarterly. When we made profits it was decided by the CEO that we had insufficent cash flow to pay it so book it for later. I was also working agreed overtime on the weekends. My CEO recently stoped the overtime due to lack of funds but told me if I worked anyway he would pay the equivenet out of the bonus I was owed. So he now depreciates the bonus amount whenever i am paid the overtime. This seems like extortion to me but i need the money. Thoughts?

Labor Code Violation

You were entitled to a bonus, per your agreement. "Insufficient cash flow" is not an excuse for failure to pay. However, if you are a VP in terms of actual duties, you are probably not entitled to mandatory overtime pay.

Due to your location, you may have trouble finding an attorney. Consider filing a complaint with the DLSE (Labor Commissioner).
