Can I file unemployment without retaliation?

I was terminated for comping a guest's tab/check of a guest that frequent the establishment. The guests know the owners and have done business with them. One of the other managers and/or server told told the regional manager/owner that when I shook the parties hand that money was exchanged. Had a sit down with the owners and explained what I did and why I did it (the comping)..I told them that I did not benefit in any way for comping their tab and money was not exchanged. They said it looked suspicious still and had no other recourse but termination. They said they would not press charges because it was considered theft and if I would not file unemployment they would let it go. At the time I had a personal loan with the company and they took my entire check to cover the loan but I received a check for the one day I worked for new pay period which they did not take to cover the alleged theft(comped tab $425) The guest's AGM of one of his businesses contacted me by accident and during conversation I explained to her that I was terminated because I comped a portion of her boss's tab and he over heard us in the background and got on the phone and I told him the whole thing including the supposedly money exchange between us, he was floored and upset, told me that he and his business partners had no problem going and paying the portion that I comped off if it was such a big deal...Note: I told the owner that if I allegedly took money from the guest then why would I call him from work that same day to get a $100 loan that he approved. My question is can I file unemployment without being retaliated against ie; theft charges being filed against me because I filed for unemployment?
