undesired of filing a complaint

1 - If I file a complaint againts my last employer. Will this affect me when I am looking for another job?

2 - Can I file a complaint if I am thinking that my employer let me go because of my ascent since I am mexican with citizenship in the US or maybe because of my sickness in the last month and two days after I had request personal leave to attend a doctor's appointment and 3 of 5 days of vacations to go though a tonsillitis surgery and after been working for almost 4 years?

You Need a Lawyer

1. There is no certain answer. If you file a charge of discrimination with the EEOC, that is considered private under the law. But, your former employer will know that you did it -- and may or may not say anything about it should someone call it for a reference on you. There is no guarantee, although most employers are careful about not saying very much when they receive calls for references. But, there are just mean people out there who could say something bad -- and they could say something bad about you even if you do not file a discrimination complaint.

2. If the fact that you are originally of Mexican national origin played a role in your termination, that could be illegal. A lawyer can help you figure this out. Or, if the company is big enough, you might have a claim under the Family & Medical Leave Act. A lawyer can help you figure that out too.

3. Two suggestions: (a) read about your rights at a website called www.workplacefairness.org. (b) find a lawyer by looking at the website www.nela.org. there are almost 30 lawyers in Texas who are listed there, and at least one in the Valley, with others in Victoria and San Antonio.
