Wrongfull termination

Mel can you please tell if I have a case. I worked for KS Management where I was fultime employee for almost a year. I had been with company for over three years as temp.I believe I was wrongfully terminated on April 12,2002.
I had a run in with a supervisor about a fax machine.I was told not to use this fax machine because it was for the customer service department. I left the area and went back to my desk and proceeded to ask my other co-worker why we could not use the fax machine. She told me she was not sure but I should go and ask the Ofc. Manager. I went over to her ofc but she had another co-worker in with her, so I went back to my desk. A little later the Ofc. Mamger and the supervisor came over to my area and said that the fax was not to be used by anyone but Customer service.
The Manager asked me to come into her ofc and I explained to her that I was on the phone with the insurance company and I would be there as soon as I got the information I had requested for a patient.
When I went to her office to talk to her and tell my side of the story she told me not to worry about it, that she had to take care of something else.
Later that afternoon I recieved a call from The Ofc Manager asking me to come into her office, which I did. When I got to her office she had the HR manager in with her and told me that I was terminated. She did not ask me what had happened she just told me that I was overheard using profanity about the supervisor and this was against the Policy. I tried to explain what had happened but she refused to listen to what I had to say. I would like to know if I can be terminated because of what someone else said. I was not overheard by the supervisor or the Ofc Manager, and I had never been writen up. Can an employer terminate you because another employee said you have said something about someone?

employment at will

You should consult an attorney and/or the EEOC with the full story, but with the facts as presented you will have a tough case to prove. It is employment at will in Texas. This means that the employer does not have to have a valid reason to fire you. Of course, there are certain reasons that the employer cannot fire you, such as because of your race, gender, etc. For a more detailed explanation of Texas employment laws, visit my web site at www.houstonattorneys.com.
