What rights does a US citizen have for a non-compete drafted in Canada?

I am attempting to hire a person that has a non-compete with a company from Canada (he is from the U.S.). The employee was terminated but there is a clause in the non-compete that states even on termination the agreement is still valid. Also the non-compete is for North America, which is excessive. I am nervous to hire the individual because I can also be held accountable. I am wondering if there is any international regulations regarding non-competes. I want this person!! Any thoughts?
