Money lost because employer failed to communicate FSA submission deadline

Hello,

My employer has an FSA plan, but failed to ever communicate to me, in writing or verbally, that the submission deadline for 2009 was January 30, 2010. Now they say I have forfeited my $900 in contributions, and I have no recourse. Can I hold them negligent and recover my 2009 contributions?
