May a company lawfully fill a position that was previously eliminated?

An employee receives a severence package in September, stating job elimination. The exact position (same title and functions) is posted immediatley and the position is then filled by an external candidate the following January. The employee receiving the severence and job elimination received no disciplinary action, and received top marks on job performance evaluation; among awards for performance from the company as well as outside sources. Is this a legal move for the company to have made?
