I filed a grievance against my boss hours before I was laid off. Is it OK they are investigating now

I filed a grievance against my boss(ED) to the head of the board hours before I was laid off. The board had my boss address the grievance at the lay off even though it was against her, I refused. They offered me a severance package with a gag order which I desperately needed and I signed it. 2 months later I get a call from the HR company the agency uses saying they are investigating the grievance I submitted and would like to talk to me. Does this make the Severance agreement null and void.? Isn't the entire process illegal. This has happened to several Directors before me but no one had filed a grievance.
