Do I have a case?

I am on intermittant FMLA that started back on 7/10/2010. I was out prior to my FMLA for 37 hours without pay, but the hours were approved as time off before taken. I have never been counceled, written up or verbally warned on my attendance. I received my my annual eval on 7/20 from my manager which she used my attendance as a negative on my evaluation and stated and written on my evaluation was that my attendance effected my dependabilty. This affected my raise and bonus for the next year. I am unsure if I have a case to fight the attendance issue but I do not think it is right to be given the time off and then it be used against you when you are now conviently on FMLA. Please advise..Thank You
