Can a termination from a drug screen be upheld even if the test was not allowed?

Company does a drug screen of all employees. Arbitrator says that blanket drug screen not allowed. Should employees who tested positive and were fired be reinstated or has, as company rumor has it, the NLRB said that even drug screens obtained from non-permissible actions are still valid and so the terminations should be upheld?
