Can My CA Employer refuse to allow accrued PTO to be used, because their accrual calculations put it over their cap amount

My employer's handbook states the PTO is capped at 40 hrs a year. However, they have been told repeatedly that the calculations they are using in their payroll to apply the accrued PTO each time period is incorrect and is accruing more than the 40 PTO hrs annually. They won't correct it, and they won't let anyone use the overage of PTO hours. They just keep rolling it over indefinitely. However, some employees are now up to 100+ banked PTO hours they cannot use.
