what are my options with an employer who has not given me final pay

on the 28th of february, my wife attempted to cash four of my paychecks. there was only enough money in my employers payroll account to cash two of them. my boss had left for the day so I tried to call him and had to leave a message. i got no reply for 2 days so called again on sunday. my employer acted suprised and asked for a couple of days to "sort things out" and find out why the checks bounced. I told my employer then that I would not be coming to work until my paychecks cleared the bank. two days later my employer had not called or put money into the accounts so I called them and told them that I would not be returning to work at all. I asked them when they would have my final paychecks available for me. that would have been february 2nd or 3rd. The two previous checks have finally cleared the bank but I have not recieved checks for my last 2 pay periods. the last one should have been monday the 7th for the last week of january.

It sounds as if you did not believe your employer and were looking for a reason to leave. Legally you are entitled to be paid and the failure to back up your pay checks could violate both federal and state law. Under Ohio law the employer is to pay the employee no later than 2 weeks after the end of the pay period.
