What is the best way to categorize my settlement if I dont claim wage replacement?

I am going to mediation soon for wrongful termination/disability violation/retaliation/ERISA violation. As I am receiving 60% pay reimbursement from a private long term disability plan, and applying for SSDI, I wanted to avoid the overpayment issues that could arise from wage reimbursement through any settlement I may receive, and I dont want to reduce my settlement amount by having to repay the disability company or SSDI. What is the best way to word the settlement amount? What tax rate can I expect to pay if I don't claim any portion as wage reimbursement?
