What if a previous employer promises to give a copy of a non-compete (or a release) but never does?

IBM is looking to hire me back but this previous employer (ironically, an IBM business partner) represented by the COO keeps saying he will e-mail me a copy of my non-compete (if he finds it in off-site storage) OR a release from said agreement. (Unfortunately, I never received a copy.)

However, he never e-mails or faxes either document.

IBM says that as long as they don't have a copy of the restrictive agreement, the hiring process cannot continue.
