Union Contract Expires before settle next contract. Can Employer refuse retroactive pay?

I belong to a union. Our employer say that if we don't settle our next contract "on time" (by the time our current contract expires) they will NOT pay retroactive pay when we eventually do settle our contract as they have always done in the past. Is this legal?
