Severance and retaliation

I WAS TERMINATED FROM MY FORMER COMPANY A BIG BANK STATING REDUCTION IN FORCE DUE TO BUSINESS SLOW DOWN. ALONG WITH ME SOME OTHER COLLEAGUES WERE ALSO TERMINATED. THE REAL REASON FOR MY TERMINATION IS OPPOSING HARASSMENT AS I AM FROM ANOTHER COUNTRY. AS I AM A RECENT IMMIGRANT UNAWARE OF THE RULES AND REGULATIONS, I SIGNED AGREEMENT RELEASING ALL CLAIMS. THE COMPANY DID NOT PAY ME SEVERANCE AS PROMISED IN THE AGREEMENT. WHEN I CHECKED MY RECORD I GOT GOOD DOCUMENTATION SUPPORTING A RETALIATION CASE. COMPANY DISCRIMINATION POLICIES WERE NOT FOLLOWED. JUST 2 MONTHS BEFORE MY TERMINATION CHAIRMAN OF THE COMPANY GAVE A LETTER TO ME STATING 'IT IS HAVING PEOPLE LIKE YOU IN THE COMING YEAR IT WILL BE EVEN BETTER FOR THE COMPANY'.SEVERANCE AGREEMENT WAS VIOLATED BY THE COMPANY BY NOT PAYING ME SEVERANCE PAY. AS THE COMPANY DID NOT FOLLOW THEIR END OF THE AGREEMENT, CAN I BYPASS THE AGREEMENT AND FILE DISCRIMINATION COMPLAINT.

The answer will depend on what a fuller examination of the facts shows. Keep in mind that filing any kind of discrimination claim must be done within 180 days of the most recent date of discrimination. If they have not lived up to the promises in the agreement, you might have a way to say that your release is not valid. Again, it will depend on the facts. Have you spoken with an attorney in Charlotte?
