Relocation Payback

I am trying to find a way out of a 36 month relocation payback contract.

I started the job 9 months ago and I still think it is a good company. But my direct supervisor is unbearable. He texted my personal cellphone more than 200 times during the 9 months. And most of the text messages are out of normal working hours before 6 am and after 10 pm. And he pulled me back from my scheduled vacations. Multiple people quit under him. And he verbally abused me. I tried to move to another department but he refused to let me go. And I talked to his boss but got retaliated. Can I use those to get out of the payback agreement? Thanks.
