Race/Religion Discrimination Harassment settlement

how much money can my Lawyer ask for in a Letter of Demand for Discrimination/Harassment? My understanding is that the cap is between 50,000 to 300,000 based on the size of the employer. I was retaliated for reporting unlawful activity at my workplace and lost my job. I worked for a large medical center and now I'm in the process of trying to settle out of court.
are out of court settlements based on Race/Religious discrimination Taxable income? is there a way to avoid having so many taxes taken out? afterall, I'm now unemployed trying to find a job with equal pay.
