OT - Multiple Rates

In a day, our crews usually work multiple job sites and may work in different capacities. My question is "Do we have to pay a 'weighted' average when time runs over into the overtime hours and there have been multiple rates throughout the day?"

For example:
Jons hours are 2 hrs travel @ $10
4 hrs Laborer @ 12
2 hrs Operator @ $16
2 hrs OT Operator @$16
2 hrs travel @$10

this is what you pay your lawyers for

brenda, your question is an interesting one, one that your regular corporate counsel should be asked. that's what you pay them for. (i am assuming you are an employer, not an employee.)

you may try to get an answer from the dept. of labor standards enforcement's nearest office. they're supposed to be able to answer questions of this kind, quickly and efficiently. however, the new labor commissioner has instituted policies that may prevent them from helping you directly. if they won't help you, you have a right to complain, as that's what your taxes are for. contact your state assemblyperson or senator if you can't get help there.
