Non-dsicretionary bonus for attrited employees

The company I work for has a non-discretionary bonus program for nonexempt staff - a performance based set of calculations to determine the bonus. The company is 6+ months behind in payments even though the company policy says (1) bonuses must be paid within 75 days of month end and (2) an employee must be employed at the time the company makes the bonus payment in order to get the bonus. In this scenario, if an employee leaves the company, are they entitled to any / all of the bonuses owed to them prior to their leaving? Note – the company does (correctly) include these bonuses in calculating non-exempt overtime rates once the bonuses are paid.
