Non Compete

If I signed a non-compete agreement and started a business for myself; and my previous employers customers start calling me (through advertising); would this be construed as me soliciting the customer? And can I do business with them if they choose to work with me?

I agree with Margie. This is a question that cannot be answered simply. Plus, even if the answer is that the employer would have a tough claim to win, the employer may choose to sue just to cause you delay or to outspend you.

To answer your question, the lawyer would have to (a) read the agreement and (b) know what was happening between you and the previous owner at the time you signed the agreement. Before you get too far down the road and wind up having to hire a lawyer because you've been sued, you should go consult with a Texas lawyer who understands this area of the law.
