Is it legal for my employer to take my PTO time without telling me I have it??

My companies policy states that at six months employment we get 40 hours PTO. It is supposed to be posted on our checks. It had not been posted on my check and questioned when I would be recieving my 40 hours PTO. I was then told that I should have recieved it more than a month ago. Then, I was informed they were going to retroactively take my vacation for missed day during that time period, based on points accrued not hours missed
