I was laid off due to the economy situation of the hotel and in 14 days they opened this position. Did not offer me to be rihired. Is it leagal?

I was an Assistant Guest Services Manager for 1,7 years. the other two were for 1 year. I was best performer, because company offered me a promotion to the Front Office Manager, I was asking for better salary and clear explanation of what will be my responsibilities - they could not provide me with what I was asking. I was thinking on the decision and when I accepted, I was told that they decided to postpone with that decision. After what they hired new FOM without officially posting the job. I was fine with that. 1 month after, they laid me off based on economy situation of the hotel. Now 14 days after they opened my position to hire. What I can do? Also, HR Director, GM, FOM, 2 AFOM were African Americans and I am not, they laid me off 1 month prior I turn 40
