I signed a non-solicitation agreement with a nanny agency

I signed a non-solicitation agreement with a nanny agency that I would not hire any nanny they refer to me for 12 months. The agency service is not working out but I would like to keep the nanny they referred. Is the non solicitation clause upheld in California?
