Been with company 18 years. Left for new job. Old policy states that they pay vacation when you terminate employment if you have been with company over 10 years and are over 50 years old. I am 52. I worked 2 week notice and was expecting to be paid for the 2 weeks of my vacation that was not taken. HR refusing to pay me saying that the policy changed to 55 years of age. Is this legal?

N.C.Gen.Stat. 95-25.12 addresses this question. You should be able to pull the statute wording off the net. If you were not notified of the change, you should be paid. You can file a claim with the NC Dept of Labor if you can't resolve this yourself.
