I have an employee who was been on a worker comp leave since 12-30-09

I just got a letter from the worker comp carrier saying the emploee is eligible for a supplemental job displacement and the ee is 13% permanent partial disability, when can I terminate this employee.

Why do you want to terminate the employee? Have you considered the employee may be perfectly capable of performing his or her job, or another job you have available, even with the 13 per cent disability? Perhaps all the employee needs is a reasonable accommodation.
