Enforceable non compete?

I'm currently starting up a business here in Florida. I'm looking to hire someone as an employee to work from his home in New Jersey. My candidate is unsure about working for me because he currently has a non-compete that he signed while he was working from his NJ home as an independent contractor for a Chicago based company. Does his non-compete hold up if he is employed by my Florida based company working from his New Jersey home?

Depends upon the terms of the non-compete agreement. Give me a call if you want to discuss further.
