Can a company instate a new regulation and count time off retroactively?

My company started a new policy for how many vacation days we can take. Before this policy was in place, we did not have one, and I had taken some days. When the new policy was put into place, my boss counted my days retroactively, counting the days that I had taken before this policy even existed. Is this legal?
