should we be paid for all hours operating a dump truck?

our pay does not start until we get to jobsite, which could be anywhere from one half to two and a half hours per day plus the drive home, they do however pay us 1 hour of drive time per day,we drive company trucks there and home,we are home most every night, there are 26 drivers here and they have been doing this for the last 8 plus years, except for two years that they paid us for all our time

Your entitlement to pay may depend on whether your travel is limited to instate (Ohio) The gross vehicle weight rating for your vehicle will also be another important factor.

Feel free to contact me if you would like to further explore this.

This is a difficult area due to some of the exceptions statutorily to the FLSA. Based upon your question I cannot determine what type of trucks in what context to decide whether or not the motor carrier exception applies to your particular work.

You need to speak to an employment lawyer as the pay amounts will start to drop out after 3 years. You can select an attorney near you at www.oelasmart.net/directory
