vacation/overtime pay

I have recently quit my job. I was not paid for vacation that was not taken, we are paid an overtime check at the end of each month which makes up my base salary and that was not paid. Also the company has a safety award that I have accumalated over 17 years of service that they do not want to pay. I belong to a building trades Union but for this company I was in management but still under the Union, They are telling me because I am still a Union member that I do not have vacation accrued, the vacation time that I received they are saying it is actually comp time thereore they will not pay. Do they owe me vacation and overtime?

Unpaid Wages & Vacation

The Texas Workforce Commission will investigate claims for unpaid wages -- and you won't have to retain a lawyer. Texas law does not require employers to pay for accrued but unused vacation time UNLESS the employer has a written policy saying that it will pay employees for unused vacation time when they leave the company's employment. Yuck! But that's the law. The TWC might be able to help you with the overtime claim too, but if those folks cannot, go to the U.S. Department of Labor's Wage & Hour Division and file a claim for unpaid overtime. You may be SOL on the safety award monies, but you can ask for it when you make your claim through the TWC.
