vacation time and fmla

At the beginning of this year I gave a notice to take my 2 weeks vacation from 9/8 to 9/21, returning to work on the 22nd. I am driving cross country from ohio to nevada with their pets. It will be 4.5 days each way. Recently I ended up in the hospital for 3 days and I am able to return to work on Monday. They are getting fmla papers together for me, but now I am being told that they will be takinsg vacation time away from me to cover it. I will have to do this drive with 1 maybe 2 days to rest in between and getting back to go to work in the morning on the next day.

You may want to see whether the employer will give you the days unpaid to take the trip in the same time period.

Employers can substitute paid time off (such as vacation time and PTO) for FMLA. Perfectly legal.
