my former employer did not deposit withheld 401k funds, or required Safe Harbor matching in my 401k account. Besides reporting to dept. of labor (I have), do I have legal recourse for damages? I could use those funds now to live on, since they fired me.

Company withheld voluntary contributions from pay, but did not deposit all of these contributions to 401K fund, nor the required Safe Harbor match. My account is about 50% shy of funds that should have been deposited, and also shy the accrued interest that should have been applied.
I have been terminated, and the funds are still not in my account.
