loss of severance pay if I accept a position at another place

The preschool that I work for is closing down. They have offered severance pay in writing. The preschool up the street that has agreed to take our children & some of our teachers. It was stated verbally that if I accept a job from this preschool I would not be intitled to my severance pay. Can they do that?

this is probably illegal

the agreement you're being asked to sign is in reality a noncompete agreement. these are illegal under california law. however your case is complicated by the fact that they are offering money in exchange for your promise not to compete. you should contact an attorney experienced in employment law to discuss this with. there are several in the slo-paso area. you can find one at the cal employment lawyers assn website, www.
