can a potential employer refuse to give you a job app?

I was following a lead for a job that I was certain I was perfect for. I entered the business and politely asked for a job app. Upon reciept of the app, I discovered that I had no pen. I asked to borrow one, and instead of the person being nice and loaning me one, he took the app back and told me to leave. I would like to know if he broke the law in doing this. I mean it is his perogative not to hire me, but to deny me an app just because I had no pen is ludicrous.
