Unemployment compensation appeal by former employer.

I was terminated for violating company policies in April 2009, and had to have a hearing with the Ohio Department of Job and Family Services (telephone hearing) to determine if they would pay my unemployment compensation or not. Now, my former employer is requesting an appeal of the initial determination from ODJFS. ODJFS found that even though I violated company policy, that in accordance with Ohio Revised Code section 4141.29, the disciplinary layoff was found to be non-disqualifying for benefits, and that the employer failed to establish negligence or willful disregard on the part of myself. Also, they found that my acts, omissions, or course of conduct were such that an ordinary person would find the discharge not justifiable. 1.) How easy is it going to be for my former employer to win the appeal of the initial determination, and 2.) their appeal says there is attached documentation, which was not sent to me, am I entitled to a copy of that documentation? I will tell you that the company has a progressive disciplinary policy, of which in just shy of 18 years of service, I had only had 1 previous violation of the policy, which stemmed from my omission to inform a supervision of something that happened while he was on vacation, SOME TIME previous to my omission, and that I had requested statements from the parties involved, and never received them prior to my supervisors return from vacation. I have had several duty commendations, and always received high marks on my annual reviews. Thank you for your time in answering these questions.
