Selective Layoff

My wife got layoff two weeks ago and later she found out the mojority of the layoffs are oriental people and also parents who need to leave early to pick up kids from school even they have put in more than 8 hours a day. Can we file a charge based on these factors?

racial discrimination in layoffs is illegal

if it can be demonstrated that the company intentionally targeted asians for layoff, this is illegal discrimination. it is not so clear whether those who cannot work mandatory overtime cannot be targeted. the employees should talk to an attorney experienced in employment law. if you are in southern california, please call me for a consultation.
