REPAYMENT OF SIGN-ON BONUS

MY DAUGHTER WAS RECRUITED FROM HER COMPANY TO TAKE A JOB THAT INVOLVED A SUBSTANTIAL CUT IN SALARY BUT WITH THE PROMISE OF A COMPANY CAR, A SIGN ON BONUS, HER CELL PHONE AND TELEPHONE PAID. SHE WORKED FROM HER HOME, SO THERE WAS NO OVERHEAD. SHE BECAME VERY DISILUSIONED BECAUSE THE CAR WAS NEVER PRODUCED, HER PHONE BILL BECAME DELINQUENT MORE THAN ONCE AND ON AND ON. HER OLD COMPANY ASKED HER TO COME BACK AND SHE HAS DONE SO. THE COMPANY IN QUESTION IS ASKING FOR HER SIGN-ON BONUS BACK. SHE DOESN'T FEEL SHE SHOULD HAVE TO PAY IT AS THEY FAILED TO LIVE UP TO THEIR PROMISES. THEY ARE THREATENING HER LEGALLY AND ARE IMPLYING THEY WILL RUIN HER CREDIT. WHAT IS HER RECOURSE?

I suggest you seek a local attorney and have the attorney send a letter to the company. The technical answer to your question is that she should pay the money back and then go after the company for any damage it caused her from a breach of contract and possibly fraud and misrepresentation. However, you may be able to resolve it by sending a letter from an attorney and then negotiating.
