Possible age descrimination

My husband works for a company in Birmingham, AL. He has over 30 years and is 58 years old. They offered a very small severance package to those age 55 and over with 20 years or more with the company. If the company does not get enough takers, they will lay off those who did not take the package. My husband's supervisor is in his 40's and has almost 30 years in. Since he is not 55 or older, he is exempt. My husband plans to decline the package (six months pay only). The company is non-union. Offer has the standard stuff (ADEA, lawyer, forbidding employment with competitor, etc). Thank you.
