My husband got fired 2 months a go, and we went to file for help with food stamps, and we found out that his previous employer still uses his social security number, I mean he is still employed, can we sue them for this?

My husband got fired but previous employer never terminated his employment. Is been 2 months, and now we need help with food stamps and we cannot get it. Is really frustrating since I'm the only one working and we barely make enough to pay our bills so we really need help with food. We have a one year old baby.
