Loss of benefits

I was in a car accident and as a result took an extended medical leave of absence from work. I was just told after being back in my old position for 3 weeks that the day I came back to work was my first day of employment and I would have to wait one year for all of my benefits(except 401k?). I did not expect my vacation time for my time off but making me start at day one? Is that legal?

Your question should have a simple answer, but based upon the lack of facts I cannot give you an answer that would be accurate. You should get the basic facts together, employer size, length of time off, type of job, company policies on non-job related injuries, company handling of time off, and then you may get some answers from an employment attorney.
